These Terms govern your access to and use of Tooltap (the "Service"). By creating an account, buying credits, or using the Service (including through an AI assistant or API), you agree to these Terms. If you are using the Service for an organisation, you agree on its behalf.
Tooltap is a tool that retrieves information from publicly available sources on your instruction and returns it to you as a structured, exportable table. You choose what to look up and what to do with the results. Tooltap does not decide what you collect or how you use it.
You direct the Service, and you are solely responsible for what you collect and how you use it. You agree that:
You, not Tooltap, are the controller of any personal information you collect through the Service. Tooltap merely retrieves and processes it on your instruction.
Data comes from third-party public sources and may be incomplete, out of date, or inaccurate. The Service is provided "as is" and "as available." We do not warrant that results will be accurate, complete, lawful for your purpose, or uninterrupted, and third-party sources may change or restrict access at any time.
To the maximum extent permitted by law, Tooltap and its operators will not be liable for any indirect, incidental, special, or consequential loss, or for lost profits, data, or goodwill, arising from your use of the Service or the data you obtain through it. Our total liability for any claim is limited to the amount you paid us in the three months before the event giving rise to the claim. Nothing in these Terms excludes rights that cannot lawfully be excluded, including under the Australian Consumer Law.
You agree to indemnify and hold harmless Tooltap and its operators from any claim, loss, or expense (including reasonable legal costs) arising from your use of the Service, the data you collect or how you use it, or your breach of these Terms or of any law.
We may suspend or terminate access if we reasonably believe the Service is being used unlawfully or in breach of these Terms. You may stop using the Service at any time.
We may update these Terms. Material changes will be reflected by the "last updated" date, and continued use after a change means you accept it.
These Terms are governed by the laws of New South Wales, Australia, and the courts of that jurisdiction have exclusive jurisdiction, without limiting any mandatory consumer rights you have where you live.
